Concussion Laws in All 50 States: What's Required, What's Recommended, and What's Missing
Understanding what your state actually mandates is critical — and the answer is more complicated than you might think.
Every state in the U.S. plus the District of Columbia has enacted a youth sports concussion law. This legislative wave began with Washington State’s Zackery Lystedt Law in 2009 and spread to all remaining states by 2014. But the requirements vary enormously, and understanding what your state actually mandates is critical.
The three near-universal provisions
According to a comprehensive analysis published in PMC (Harvey, 2013) and updated by the National Conference of State Legislatures (NCSL), most state laws share three core provisions:
- Immediate removal from play when a concussion is suspected.
- Written clearance from a qualified healthcare provider before return to play.
- Annual concussion education for coaches and/or parents.
Where states diverge
Where states diverge dramatically is on baseline testing. According to the NCSL database, only approximately 4 states include any form of baseline testing requirement in their concussion legislation. The vast majority leave baseline testing as a recommendation, a best practice, or simply unmentioned. Most state laws also apply only to school-sponsored interscholastic athletics, leaving club sports, recreational leagues, travel teams, and community programs completely unregulated.
Other significant gaps
Other significant gaps identified in the legal literature include: inconsistent definitions of who qualifies as a “licensed healthcare provider” for clearance purposes (ranging from physicians-only to broad categories including chiropractors in some states), limited or absent enforcement mechanisms, no requirements for return-to-learn (academic) accommodations in the vast majority of states, and no provisions for data collection or outcome tracking.
